Bu kapsamda yer alan i\u015f\u00e7iler, g\u00fcnde yedi bu\u00e7uk saatten fazla \u00e7al\u0131\u015ft\u0131r\u0131lamaz ve gece \u00e7al\u0131\u015fmas\u0131 yapt\u0131r\u0131lamaz. Ayr\u0131ca, do\u011fumdan \u00f6nce sekiz hafta, do\u011fumdan sonra sekiz hafta olmak \u00fczere izin kulland\u0131r\u0131l\u0131r. Do\u011fum sonras\u0131 d\u00f6nemde kad\u0131n i\u015f\u00e7ilerin g\u00fcnde bir bu\u00e7uk saat s\u00fct izni bulunmakta; i\u015f\u00e7i dilerse, bu s\u00fcrenin yerine, ilk do\u011fumda altm\u0131\u015f, ikinci do\u011fumda y\u00fcz yirmi ve sonraki do\u011fumlarda y\u00fcz seksen g\u00fcn boyunca \u00e7al\u0131\u015fma s\u00fcresinin yar\u0131s\u0131 kadar veya alt\u0131 ay boyunca tam zamanl\u0131 \u00fccretsiz izin kullanabilir. Bu s\u00fcreler ve i\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131r\u0131lma ko\u015fullar\u0131 i\u015f\u00e7i aleyhine de\u011fi\u015ftirilemez.<\/em><\/strong><\/p>\n<p><strong><u>A\u00c7IKLAMALAR:<\/u><\/strong><\/p>\n<p>\u00c7al\u0131\u015fma hayat\u0131nda aktif olarak yer alan kad\u0131n i\u015f\u00e7ilerin gebelik, do\u011fum sonras\u0131 ve evlat edinme halleri 4857 say\u0131l\u0131 \u0130\u015f Kanunu ve ilgili y\u00f6netmelik kapsam\u0131nda baz\u0131 \u00f6zellikli d\u00fczenlemelere sahiptir. Ancak T\u00fcrk Bor\u00e7lar Kanunu kapsam\u0131nda hizmet s\u00f6zle\u015fmesiyle \u00e7al\u0131\u015fan i\u015f\u00e7iler i\u00e7in de gebelik ve do\u011fum sonras\u0131 izinler y\u00f6n\u00fcnden \u0130\u015f Kanunu h\u00fck\u00fcmleri uygulanmaktad\u0131r. \u00d6ncelikli ama\u00e7, kad\u0131n\u0131n i\u015f hayat\u0131ndan geri kalmamas\u0131d\u0131r. Anayasa\u2019da, kad\u0131nlar\u0131n \u00e7al\u0131\u015fma \u015fartlar\u0131n\u0131n \u00f6zel olarak korunaca\u011f\u0131, Devlet taraf\u0131ndan al\u0131nacak baz\u0131 tedbirlerin e\u015fitlik ilkesine ayk\u0131r\u0131l\u0131k yaratmayaca\u011f\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Bu kapsamda, gebe veya emziren i\u015f\u00e7i g\u00fcnde yedi bu\u00e7uk saatten fazla \u00e7al\u0131\u015ft\u0131r\u0131lamaz. Ayr\u0131ca gebe kad\u0131na veya do\u011fumdan sonra \u00e7al\u0131\u015fmakta olan kad\u0131na bir y\u0131l boyunca gece \u00e7al\u0131\u015fmas\u0131 yapt\u0131r\u0131lamaz. Bu s\u00fcreler doktor raporu ile uzat\u0131labilir, ancak i\u015f\u00e7i aleyhine k\u0131salt\u0131lamaz. Yine kad\u0131n i\u015f\u00e7inin, mevcut i\u015fini devam ettiremeyece\u011fi doktor raporu ile tespit edilmi\u015fse; i\u015f\u00e7i ge\u00e7ici olarak, sa\u011fl\u0131k durumunun elverdi\u011fi ba\u015fka bir i\u015fte \u00e7al\u0131\u015ft\u0131r\u0131lmal\u0131d\u0131r. Ancak gebe veya yeni do\u011fum yapan i\u015f\u00e7iye fazla \u00e7al\u0131\u015fma yapt\u0131r\u0131lamaz.<\/p>\n<p>\u0130\u015f Kanunu\u2019nun 74. maddesi ile gebe kad\u0131nlara do\u011fum \u00f6ncesi sekiz hafta ve do\u011fumdan sonra sekiz hafta izin kulland\u0131r\u0131lmas\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Ancak kad\u0131n\u0131n sa\u011fl\u0131k ko\u015fullar\u0131n\u0131n elvermemesi halinde, bu s\u00fcreler doktor raporu ile uzat\u0131labilmektedir. Yine gebelik s\u00fcresince i\u015f\u00e7iye, periyodik doktor kontrolleri i\u00e7in i\u015fveren taraf\u0131ndan izin verilmesi gerekir. Kad\u0131n i\u015f\u00e7i, do\u011fum \u00f6ncesi sekiz haftal\u0131k izninin tamam\u0131n\u0131 kullanmay\u0131p, bu s\u00fcreyi do\u011fum sonras\u0131 izinlerine eklemek isterse ve \u00e7al\u0131\u015fmas\u0131 doktor raporuyla uygun bulunursa, bu teklifin i\u015fveren taraf\u0131ndan kabul edilmesi gerekir. Ancak do\u011fuma en fazla \u00fc\u00e7 hafta kalana kadarki d\u00f6nemde kullan\u0131lmayan izin, do\u011fum sonras\u0131na devredilebilecek, i\u015f\u00e7i 37. haftadan sonra \u00e7al\u0131\u015ft\u0131r\u0131lamayacakt\u0131r. Yine erken do\u011fum gibi hallerde, kad\u0131n i\u015f\u00e7i do\u011fum \u00f6ncesi iznini kullanamam\u0131\u015f ise, bu s\u00fcreler do\u011fum sonras\u0131 izinlerine eklenmektedir.<\/p>\n<p>Do\u011fum sonras\u0131 kullan\u0131lmas\u0131 \u00f6ng\u00f6r\u00fclen sekiz haftal\u0131k izin, kad\u0131n i\u015f\u00e7inin \u00f6l\u00fcm\u00fc halinde babaya kulland\u0131r\u0131l\u0131r. Keza, \u00fc\u00e7 ya\u015f\u0131ndan k\u00fc\u00e7\u00fck bir \u00e7ocu\u011fu evlat edinen e\u015flerden birine veya bizzat evlat edinmi\u015f olana da, evlat edinilenin fiilen teslim al\u0131nd\u0131\u011f\u0131 tarihten itibaren sekiz haftal\u0131k izin kulland\u0131r\u0131l\u0131r.<\/p>\n<p>Do\u011fum \u00f6ncesi ve sonras\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015f izin s\u00fcrelerinin bitimi itibariyle kad\u0131n i\u015f\u00e7iye veya \u00fc\u00e7 ya\u015f\u0131n\u0131 doldurmam\u0131\u015f \u00e7ocuk evlat edinen i\u015f\u00e7iye, iste\u011fine ba\u011fl\u0131 olarak baz\u0131 \u00e7al\u0131\u015fma kolayl\u0131klar\u0131 tan\u0131nm\u0131\u015ft\u0131r. Bunlardan ilki kanunen 45 saat olarak \u00f6ng\u00f6r\u00fclm\u00fc\u015f haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresinin yar\u0131s\u0131 kadar \u00fccretsiz izin uygulanmas\u0131d\u0131r. S\u00f6z konusu bu uygulama, i\u015f\u00e7inin talebi \u00fczerine i\u015fveren taraf\u0131ndan kabul edilmelidir ve ilk do\u011fum i\u00e7in altm\u0131\u015f g\u00fcn, ikinci do\u011fum i\u00e7in y\u00fcz yirmi g\u00fcn ve sonraki do\u011fumlar i\u00e7in y\u00fcz seksen g\u00fcn boyunca ve \u00e7o\u011ful do\u011fum hallerinde mevcut s\u00fcrelere otuz g\u00fcn eklenmesi ile uygulan\u0131r. Ancak \u00e7ocu\u011fun engelli olmas\u0131 halinde belirtilen s\u00fcrelere bak\u0131lmaks\u0131z\u0131n bu \u00e7al\u0131\u015fma \u00fc\u00e7 y\u00fcz altm\u0131\u015f g\u00fcn boyunca uygulanabilir. K\u0131smi \u00e7al\u0131\u015fmalar ve kanunda \u00f6ng\u00f6r\u00fclen di\u011fer izin s\u00fcreleri boyunca \u00e7al\u0131\u015f\u0131lmayan haller, i\u015f\u00e7iye bir ba\u015fka tarihte tamamlat\u0131lamaz, mesaisi olmayan bir g\u00fcnde kural olarak i\u015f\u00e7i i\u015fe \u00e7a\u011fr\u0131lamaz.<\/p>\n<p>Kad\u0131n i\u015f\u00e7ilere ve \u00fc\u00e7 ya\u015f\u0131n\u0131 doldurmam\u0131\u015f \u00e7ocu\u011fu evlat edinme h\u00e2linde e\u015flerden birine veya evlat edinene tan\u0131nm\u0131\u015f ikinci bir se\u00e7enek olarak, do\u011fum sonras\u0131 kullan\u0131lan iznin akabinde alt\u0131 aya kadar tam zamanl\u0131 \u00fccretsiz izin hakk\u0131 mevcuttur. Ancak bu s\u00fcre, y\u0131ll\u0131k \u00fccretli izin hakk\u0131n\u0131n hesab\u0131nda dikkate al\u0131namaz. Gerek k\u0131smi s\u00fcreli gerek tam zamanl\u0131 kulland\u0131r\u0131lan \u00fccretsiz izinler boyunca, \u00e7al\u0131\u015f\u0131lmayan s\u00fcrelere dair i\u015fveren taraf\u0131ndan herhangi bir \u00fccret \u00f6demesi yap\u0131lmamaktad\u0131r. \u00dccretsiz izin kullanan i\u015f\u00e7inin izin s\u00fcresini keserek \u00e7al\u0131\u015fmaya ba\u015flamas\u0131 halinde, \u00fccretsiz izin hakk\u0131ndan tekrar yararlanmas\u0131 m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p>Kanunen tan\u0131nm\u0131\u015f izin s\u00fcrelerinin bitiminden sonra, her iki ebeveynin de \u00e7al\u0131\u015f\u0131yor olmas\u0131 durumunda sadece bir ebeveyn veya \u00e7ocu\u011fun velayeti \u00fczerinde olan ebeveyn yahut \u00e7ocu\u011fu tek ba\u015f\u0131na evlat edinen i\u015f\u00e7i, \u00e7ocu\u011fun mecburi ilk\u00f6\u011fretim \u00e7a\u011f\u0131n\u0131n ba\u015flad\u0131\u011f\u0131 tarihi takip eden ay ba\u015f\u0131na kadar k\u0131smi s\u00fcreli \u00e7al\u0131\u015fma talebinde bulunabilir. \u00c7al\u0131\u015f\u0131lmayan s\u00fcreler i\u00e7in yeni bir i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr. K\u0131smi s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7inin, en az bir ay \u00f6nceden i\u015fverene yaz\u0131l\u0131 olarak bildirmek ko\u015fuluyla i\u015fe d\u00f6nmesi ile i\u015f\u00e7inin yoklu\u011funda ge\u00e7ici olarak istihdam edilen i\u015f\u00e7inin i\u015f akdi de kendili\u011finden sonra erer.<\/p>\n<p>Yukar\u0131da yer verilen s\u00fcreler haricinde, \u00e7al\u0131\u015fmaya ba\u015flayan kad\u0131n i\u015f\u00e7iye, \u00e7ocuk bir ya\u015f\u0131n\u0131 doldurana kadar g\u00fcnde bir bu\u00e7uk saatlik s\u00fct izni verilmektedir ve bu s\u00fcre \u00e7al\u0131\u015f\u0131lan s\u00fcrelerden say\u0131lmaktad\u0131r. S\u00fct izninin kulland\u0131r\u0131lmas\u0131 zorunlu olup \u00e7ocu\u011fun bak\u0131m\u0131 i\u00e7in verilen s\u00fcrelerden i\u015f\u00e7inin feragat etmesi m\u00fcmk\u00fcn de\u011fildir. S\u00fct izninin hangi saatlerde kullan\u0131laca\u011f\u0131 i\u015f\u00e7i taraf\u0131ndan kararla\u015ft\u0131r\u0131lmal\u0131d\u0131r. \u0130\u015f\u00e7inin talebi ile bir arada kullan\u0131labilen s\u00fct izni, h\u00fckm\u00fcn amac\u0131n\u0131 a\u015facak \u015fekilde bir toplu bir izin kullan\u0131m\u0131 yaratamaz.<\/p>\n<p>\u00d6ng\u00f6r\u00fclen d\u00fczenlemeler ve izin s\u00fcreleri, i\u015fverene i\u015f\u00e7inin i\u015f akdini feshetme hakk\u0131 vermez ve kad\u0131n i\u015f\u00e7iye gebelik veya anal\u0131k nedeniyle ayr\u0131mc\u0131l\u0131k uygulanamaz. Ancak anal\u0131k iznine dair s\u00fcrelerin \u00fczerinden alt\u0131 haftan\u0131n ge\u00e7mesine kar\u015f\u0131n, i\u015f\u00e7i i\u015fe ba\u015flamam\u0131\u015f ve kanuni izinlerini kullanm\u0131yor ise, i\u015fveren taraf\u0131ndan i\u015f akdi bildirimsiz olarak feshedilebilir.
