Her ne kadar Kanun\u2019un y\u00fcr\u00fcrl\u00fc\u011fe giri\u015finin \u00fczerinden uzun bir s\u00fcre ge\u00e7mi\u015f ise de uygulamada teredd\u00fctler olu\u015fabilmektedir. Zira Kanun, \u00e7al\u0131\u015fmaktan ka\u00e7\u0131nma hakk\u0131 konusunda \u00f6nemli ayr\u0131mlar i\u00e7ermektedir.\u00a0<\/span><\/p>\n<p><b>\u00c7al\u0131\u015fmaktan ka\u00e7\u0131nma hakk\u0131ndan hangi \u00e7al\u0131\u015fanlar faydalanabilir?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Kanun\u2019un \u201cKapsam ve istisnalar\u201d ba\u015fl\u0131kl\u0131 2.maddesi do\u011frultusunda <\/span><span style=\"font-weight: 400;\">baz\u0131 istisnalar hari\u00e7<\/span><span style=\"font-weight: 400;\"> t\u00fcm kamu ve \u00f6zel sekt\u00f6r \u00e7al\u0131\u015fanlar\u0131 bu haktan faydalanabilmektedir. Kanun, kamu ve \u00f6zel sekt\u00f6re ait b\u00fct\u00fcn i\u015flere ve i\u015fyerlerine, bu i\u015fyerlerinin i\u015fverenleri ile i\u015fveren vekillerine, \u00e7\u0131rak ve stajyerler de d\u00e2hil olmak \u00fczere t\u00fcm \u00e7al\u0131\u015fanlar\u0131na faaliyet konular\u0131na bak\u0131lmaks\u0131z\u0131n uyguland\u0131\u011f\u0131ndan bu hakk\u0131n kullan\u0131m\u0131nda kamu ve \u00f6zel sekt\u00f6r ayr\u0131m\u0131 yap\u0131lmamas\u0131 genel kurald\u0131r.\u00a0<\/span><\/p>\n<p><b>\u00c7al\u0131\u015fmaktan ka\u00e7\u0131nma hakk\u0131 istisnai olarak hangi \u00e7al\u0131\u015fanlar i\u00e7in uygulama alan\u0131 bulmaz?\u00a0<\/b><\/p>\n<p><b>\u00c7al\u0131\u015fan bak\u0131m\u0131ndan istisnai haller: <\/b><span style=\"font-weight: 400;\">Ev hizmetlerinde \u00e7al\u0131\u015fanlar, \u00e7al\u0131\u015fan istihdam etmeksizin kendi nam ve hesab\u0131na mal ve hizmet \u00fcretimi yapanlar\u00a0<\/span><\/p>\n<p><b>Faaliyet konusu bak\u0131m\u0131ndan istisnai haller: <\/b><span style=\"font-weight: 400;\">T\u00fcrk Silahl\u0131 Kuvvetleri, genel kolluk kuvvetleri ve Milli \u0130stihbarat Te\u015fkilat\u0131 M\u00fcste\u015farl\u0131\u011f\u0131\u2019n\u0131n faaliyetleri <\/span><i><span style=\"font-weight: 400;\">(Bu kurumlar\u0131n fabrika, bak\u0131m merkezi, dikimevi ve benzeri i\u015fyerleri hari\u00e7 olmak \u00fczere) <\/span><\/i><span style=\"font-weight: 400;\">,<\/span> <span style=\"font-weight: 400;\">afet ve acil durum birimlerinin m\u00fcdahale faaliyetleri, h\u00fck\u00fcml\u00fc ve tutuklulara y\u00f6nelik infaz hizmetleri s\u0131ras\u0131nda; iyile\u015ftirme kapsam\u0131nda yap\u0131lan i\u015fyurdu, e\u011fitim, g\u00fcvenlik, meslek edindirme faaliyetleri<\/span><\/p>\n<p><b>\u00c7al\u0131\u015fanlar bu hakk\u0131 hangi \u015fekillerde kullanabilir?\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">\u00c7al\u0131\u015fan ciddi ve yak\u0131n bir tehlike ile kar\u015f\u0131 kar\u015f\u0131ya kald\u0131\u011f\u0131 ve bu tehlikenin devam etti\u011fi haller ile ciddi ve yak\u0131n tehlikenin \u00f6nlenemez oldu\u011fu hallerde bu hakk\u0131 kullanabilir. Her iki durumda da tehlikenin mutlaka \u201cciddi ve yak\u0131n\u201d olmas\u0131 gerekir. Kanun\u2019un 3.maddesinde tehlike, i\u015fyerinde var olan ya da d\u0131\u015far\u0131dan gelebilecek, \u00e7al\u0131\u015fan\u0131 veya i\u015fyerini etkileyebilecek zarar veya hasar verme potansiyeli olarak tan\u0131mlanmaktad\u0131r. Tehlikenin ciddi ve yak\u0131n olup olmad\u0131\u011f\u0131na ili\u015fkin kanaat \u00e7al\u0131\u015fan\u0131n inisiyatifindedir.\u00a0<\/span><\/p>\n<p><b>\u00c7al\u0131\u015fan ciddi ve yak\u0131n tehlike ile kar\u015f\u0131 kar\u015f\u0131ya kald\u0131\u011f\u0131 ve bu tehlikenin s\u00fcrd\u00fc\u011f\u00fc hallerde hakk\u0131n kullan\u0131m\u0131 i\u00e7in nas\u0131l bir yol izlemelidir?\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">\u00c7al\u0131\u015fanlar i\u015fyerinde ciddi ve yak\u0131n bir tehlikenin varl\u0131\u011f\u0131na kanaat getirirse i\u015fyeri b\u00fcnyesindeki i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi kuruluna ya da bizzat i\u015fverene ba\u015fvurabilir. \u00c7al\u0131\u015fanlar bu ba\u015fvuruyla durumun tespitini ve gerekli tedbirlerin al\u0131nmas\u0131n\u0131 talep edebilmektedir. Kurul\u2019un acilen toplanarak ve \u0130\u015fveren\u2019in ise derhal tehlike hakk\u0131ndaki karar\u0131n\u0131 vermesi gereklidir. Tehlike durumu tutanakla tespit edilip kay\u0131t alt\u0131na al\u0131nd\u0131ktan sonra karar \u00e7al\u0131\u015fan ve \u00e7al\u0131\u015fan temsilcisine yaz\u0131l\u0131 olarak bildirilir. Bu halde \u00e7al\u0131\u015fmaktan ka\u00e7\u0131nma hakk\u0131 ancak <\/span><span style=\"font-weight: 400;\">kurul veya i\u015fverenin \u00e7al\u0131\u015fan\u0131n talebi y\u00f6n\u00fcnde karar vermesi halinde<\/span><span style=\"font-weight: 400;\"> gerekli tedbirler al\u0131n\u0131ncaya kadar kullan\u0131labilir.\u00a0<\/span><\/p>\n<p><b>Ciddi ve yak\u0131n tehlikenin \u201c\u00f6nlenemez\u201d oldu\u011fu hallerde \u00e7al\u0131\u015fan ne yapmal\u0131d\u0131r?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">\u015eayet \u00e7al\u0131\u015fan \u00f6nlenemez bir tehlikenin bulundu\u011fu kanaatinde ise \u00e7al\u0131\u015fan\u0131n i\u015fveren veya i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi kuruluna ba\u015fvuru usul\u00fcn\u00fc uygulamas\u0131na gerek bulunmamaktad\u0131r. \u00c7al\u0131\u015fan \u00f6nlenemez ciddi ve yak\u0131n bir tehlike ile kar\u015f\u0131 kar\u015f\u0131ya kald\u0131\u011f\u0131 halde derhal i\u015fyeri veya tehlikeli b\u00f6lgeyi terk ederek belirlenen \u201cg\u00fcvenli yer\u201d e gitme hakk\u0131na sahiptir. Bu halde, <\/span><span style=\"font-weight: 400;\">\u00e7al\u0131\u015fan bir kurul veya i\u015fveren karar\u0131na gerek olmaks\u0131z\u0131n <\/span><span style=\"font-weight: 400;\">gerekli tedbirler al\u0131n\u0131ncaya kadar bu hakk\u0131 kullanabilir.\u00a0<\/span><\/p>\n<p><b>\u0130\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi kurulu her i\u015fyerinde mutlaka bulunmal\u0131 m\u0131d\u0131r?\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Kanun\u2019un 22.maddesine g\u00f6re elli ve daha fazla \u00e7al\u0131\u015fan\u0131n bulundu\u011fu ve alt\u0131 aydan fazla s\u00fcren s\u00fcrekli i\u015flerin yap\u0131ld\u0131\u011f\u0131 i\u015fyerlerinde i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi kurulunun olu\u015fturulmas\u0131 gerekir. Her i\u015fyerinde kurul bulunmas\u0131 zorunlu olmay\u0131p kurulun bulunmad\u0131\u011f\u0131 hallerde \u00e7al\u0131\u015fan ciddi ve yak\u0131n tehlikeye dair kanaatini i\u015fverene bildirmelidir.\u00a0<\/span><\/p>\n<p><b>\u00c7al\u0131\u015fmaktan ka\u00e7\u0131nma hakk\u0131n\u0131n uygulama alan\u0131 bulamayaca\u011f\u0131 \u00f6zel bir hal var m\u0131d\u0131r?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Kanun\u2019un 25.maddesine g\u00f6re i\u015fyerinde i\u015fin durdurulmas\u0131 halinde \u00e7al\u0131\u015fmaktan ka\u00e7\u0131nma hakk\u0131na ili\u015fkin h\u00fck\u00fcmler uygulanmamaktad\u0131r.\u00a0<\/span><\/p>\n<p><b>\u0130\u015fverenin \u00e7al\u0131\u015fan\u0131n ba\u015fvurusuna ra\u011fmen gerekli tedbirleri almad\u0131\u011f\u0131 hallerde ne yap\u0131lmal\u0131d\u0131r?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">\u0130\u015f s\u00f6zle\u015fmesiyle \u00e7al\u0131\u015fanlar; talep etmelerine ra\u011fmen gerekli tedbirlerin al\u0131nmad\u0131\u011f\u0131 durumlarda, tabi olduklar\u0131 kanun h\u00fck\u00fcmlerine g\u00f6re i\u015f s\u00f6zle\u015fmelerini feshedebilmektedir. \u00c7al\u0131\u015fanlar\u0131n bu hakk\u0131 \u0130\u015f Kanunu\u2019nun 24\/II-f maddesinde d\u00fczenlenen \u201c\u00e7al\u0131\u015fma \u015fartlar\u0131n\u0131n uygulanmad\u0131\u011f\u0131\u201d hakl\u0131 nedenle fesih halleri kapsam\u0131nda de\u011ferlendirilmektedir.\u00a0<\/span><\/p>\n<p><b>Kamu personelleri i\u00e7in fesih hakk\u0131 bak\u0131m\u0131ndan farkl\u0131 bir durum mevcut mudur?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Kamu personelleri \u00f6zel bir hukuk s\u00f6zle\u015fmesiyle \u00e7al\u0131\u015fmad\u0131\u011f\u0131 i\u00e7in \u0130\u015f Kanunu\u2019nun 24\/II-f maddesi kapsam\u0131nda fesih haklar\u0131 mevcut de\u011fildir. Kamu personelleri idari nitelikte bir s\u00f6zle\u015fmeyle g\u00f6rev ifa etmekte olup stat\u00fcleri s\u00f6zle\u015fme ve Devlet Memurlar\u0131 Kanunu\u2019na ba\u011fl\u0131 olarak d\u00fczenlenmektedir. Nitekim Kanun\u2019un 13\/4.maddesinde de toplu i\u015f s\u00f6zle\u015fmesi ya da i\u015f s\u00f6zle\u015fmesiyle \u00e7al\u0131\u015fan kamu personelinin bu maddeye g\u00f6re \u00e7al\u0131\u015fmad\u0131\u011f\u0131 d\u00f6nemde fiilen \u00e7al\u0131\u015fm\u0131\u015f say\u0131laca\u011f\u0131 h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015f; ancak Devlet Memurlar\u0131 Kanunu\u2019nda \u00e7al\u0131\u015fmaktan ka\u00e7\u0131nma hakk\u0131 temelli bir fesih imk\u00e2n\u0131 d\u00fczenlenmemi\u015ftir.\u00a0<\/span><\/p>\n<p><b>\u00c7al\u0131\u015fmaktan ka\u00e7\u0131nma hakk\u0131n\u0131n kullan\u0131m\u0131 s\u0131ras\u0131nda \u00e7al\u0131\u015fan\u0131n \u00fccret hakk\u0131 do\u011far m\u0131?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">\u00c7al\u0131\u015fan\u0131n yasal d\u00fczenlemelere uygun \u015fekilde \u00e7al\u0131\u015fmaktan ka\u00e7\u0131nd\u0131\u011f\u0131 hallerde i\u015fverenin \u00fccret ve sair haklar\u0131 \u00f6deme borcu devam etmektedir.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kanun\u2019un 13\/2.maddesine g\u00f6re \u00e7al\u0131\u015fanlar\u0131n \u00e7al\u0131\u015fmaktan ka\u00e7\u0131nd\u0131\u011f\u0131 d\u00f6nemdeki \u00fccreti ile kanunlardan ve<\/span> <span style=\"font-weight: 400;\">i\u015f s\u00f6zle\u015fmesinden do\u011fan di\u011fer haklar\u0131 sakl\u0131d\u0131r. Kanun\u2019un 13\/3.maddesi de \u00e7al\u0131\u015fanlar\u0131n \u00f6nlenemez durumlarda \u00e7al\u0131\u015fmaktan ka\u00e7\u0131nma hakk\u0131n\u0131 kulland\u0131\u011f\u0131 durumlarda bu hareketlerinden dolay\u0131 haklar\u0131n\u0131n k\u0131s\u0131tlanamayaca\u011f\u0131n\u0131 h\u00fck\u00fcm alt\u0131na almaktad\u0131r.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Bu h\u00fck\u00fcmlere g\u00f6re k\u0131dem tazminat\u0131, ihbar tazminat\u0131 ve y\u0131ll\u0131k \u00fccretli izin hakk\u0131n\u0131n hesaplanmas\u0131nda \u00e7al\u0131\u015fmaktan ka\u00e7\u0131n\u0131lan s\u00fcrelerin de dikkate al\u0131nmas\u0131 gerekmektedir.\u00a0<\/span><\/p>\n<p><b>\u0130\u015fveren \u00e7al\u0131\u015fmaktan ka\u00e7\u0131nma hakk\u0131n\u0131 kullanan \u00e7al\u0131\u015fan\u0131na bir yapt\u0131r\u0131m uygulayabilir mi?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Kanun\u2019da belirtilen hukuki d\u00fczenlemeler do\u011frultusunda bu hakk\u0131n\u0131 kullanan \u00e7al\u0131\u015fana \u0130\u015fveren taraf\u0131ndan bir yapt\u0131r\u0131m uygulanmas\u0131 hukuken uygun olmayacakt\u0131r. Ancak \u00e7al\u0131\u015fan\u0131n Kanun\u2019da d\u00fczenlenen usule ayk\u0131r\u0131 \u015fekilde bu hakk\u0131n\u0131 kulland\u0131\u011f\u0131 hallerde disiplin cezas\u0131 uygulanmas\u0131n\u0131n \u00f6n\u00fcnde bir engel yoktur.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u0130\u015fveren usule ve hukuka uygun bir hak kullan\u0131m\u0131na ra\u011fmen i\u015f s\u00f6zle\u015fmesini feshetti\u011fi takdirde i\u015f g\u00fcvencesi \u015fartlar\u0131n\u0131 sa\u011flayan \u00e7al\u0131\u015fanlar i\u015fe iade talebiyle \u0130\u015fverene ba\u015fvurabilecektir. \u0130\u015f g\u00fcvencesinden faydalanmayan \u00e7al\u0131\u015fanlar i\u00e7in de \u00e7al\u0131\u015fma \u015fartlar\u0131n\u0131n uygulanmamas\u0131 sebebiyle haks\u0131z fesih iddias\u0131n\u0131n g\u00fcndeme gelmesi m\u00fcmk\u00fcnd\u00fcr.\u00a0<\/span><\/p>\n<p><b>\u00c7al\u0131\u015fmaktan ka\u00e7\u0131nma hakk\u0131n\u0131 k\u00f6t\u00fcye kullanan \u00e7al\u0131\u015fana kar\u015f\u0131 \u0130\u015fveren\u2019in izlemesi gereken yol nedir?<\/b><\/p>\n<p><span style=\"font-weight: 400;\">\u00c7al\u0131\u015fmaktan ka\u00e7\u0131nma hakk\u0131n\u0131n kullan\u0131m\u0131 esnas\u0131nda i\u015f s\u00f6zle\u015fmesi devam etmektedir. Ancak \u00e7al\u0131\u015fan\u0131n bu hakk\u0131n kullan\u0131m\u0131 konusunda k\u00f6t\u00fcniyetli ve bilin\u00e7li \u015fekilde \u0130\u015fveren aleyhine bir tutum izledi\u011fi hallerde \u0130\u015f Kanunu\u2019nun 25\/II maddesi kapsam\u0131nda \u201c<\/span><i><span style=\"font-weight: 400;\">i\u015fverenin g\u00fcveninin k\u00f6t\u00fcye kullan\u0131lmas\u0131<\/span><\/i><span style=\"font-weight: 400;\">\u201d sebebiyle hakl\u0131 fesih imk\u00e2n\u0131 g\u00fcndeme gelebilecektir.\u00a0<\/span><\/p>\n<p><b>\u0130\u015fveren bu s\u00fcre\u00e7te \u00e7al\u0131\u015fana farkl\u0131 bir i\u015f teklif edebilir mi?\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Bu konu hakk\u0131nda Kanun\u2019da \u00f6zel bir d\u00fczenleme bulunmamaktad\u0131r. Ancak \u00e7al\u0131\u015fmaktan ka\u00e7\u0131nma hakk\u0131n\u0131 kullanan \u00e7al\u0131\u015fana tehlike te\u015fkil etmeyen ve kendi alan\u0131yla ba\u011flant\u0131l\u0131 olan bir i\u015f teklif edilebilece\u011fi kabul edilmelidir. Zira her ne kadar \u00e7al\u0131\u015fmaktan ka\u00e7\u0131nma hakk\u0131 kullan\u0131lsa da i\u015f s\u00f6zle\u015fmesi devam etti\u011finden \u00e7al\u0131\u015fan\u0131n sadakat y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc de devam etmektedir. Teklif edilen i\u015fin \u00e7al\u0131\u015fan\u0131n alan\u0131yla ba\u011flant\u0131l\u0131 oldu\u011fu ve tehlike te\u015fkil etmedi\u011fi hallerde \u00e7al\u0131\u015fan teklifi kabul etmelidir.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00c7al\u0131\u015fan\u0131n teklifi kabul etmedi\u011fi hallerde; \u015fayet \u00e7al\u0131\u015fan \u0130\u015f Kanunu\u2019na tabi ise \u0130\u015fveren\u2019in \u0130\u015f Kanunu\u2019nun 25\/II-e maddesi gere\u011fi hakl\u0131 fesih imk\u00e2n\u0131 g\u00fcndeme gelebilir.
