G\u00fcncellenen d\u00fczenlemeler, kurumlar a\u00e7\u0131s\u0131ndan belirli y\u00fck\u00fcml\u00fcl\u00fckler getirmekte ve ihlaller durumunda ciddi idari yapt\u0131r\u0131mlar\u0131 \u00f6ng\u00f6rmektedir. Mevcut mevzuata ek olarak haz\u0131rlanan <\/span><b>Siber G\u00fcvenlik Kanunu Teklifi<\/b><span style=\"font-weight: 400;\">, idari yapt\u0131r\u0131mlar\u0131 daha kapsaml\u0131 bir \u00e7er\u00e7evede ele almakta ve \u00e7e\u015fitli sekt\u00f6rlerde yeni y\u00fck\u00fcml\u00fcl\u00fckler do\u011furmaktad\u0131r.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Siber G\u00fcvenlik Kanunu Teklifi, <\/span><b>12 Mart 2025 tarihinde T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi (TBMM) Genel Kurulu&#8217;nda kabul edilerek yasala\u015fm\u0131\u015ft\u0131r<\/b><span style=\"font-weight: 400;\">. Bu yeni Kanun, kamu kurum ve kurulu\u015flar\u0131, kamu kurumu niteli\u011finde meslek kurulu\u015flar\u0131, ger\u00e7ek ve t\u00fczel ki\u015filer ile t\u00fczel ki\u015fili\u011fi bulunmayan kurulu\u015flar\u0131n siber sald\u0131r\u0131lara kar\u015f\u0131 korunmas\u0131na y\u00f6nelik gerekli d\u00fczenlemeleri i\u00e7ermekte ve \u00fclkenin siber g\u00fcvenli\u011fini g\u00fc\u00e7lendirmek i\u00e7in strateji ve politikalar\u0131n belirlenmesini ama\u00e7lamaktad\u0131r.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Bu Kanun\u2019un kabul edilmesiyle birlikte, t\u00fcm \u00f6zel sekt\u00f6r \u015firketleri, \u00f6zellikle dijital altyap\u0131ya sahip i\u015fletmeler, siber g\u00fcvenlik \u00f6nlemlerini art\u0131rmak ve belirlenen d\u00fczenlemelere uymakla y\u00fck\u00fcml\u00fc olacakt\u0131r.<\/span><\/p>\n<ol start=\"2\">\n<li><b> Siber G\u00fcvenlik Kanunu\u2019nun Temel Ama\u00e7lar\u0131<\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Kanun teklifi, ulusal g\u00fcvenlikten veri korumas\u0131na kadar geni\u015f bir perspektifle haz\u0131rlanm\u0131\u015ft\u0131r. Temel ama\u00e7lar\u0131 aras\u0131nda:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Siber tehditlerin tespit edilmesi ve \u00f6nlenmesi,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Kamu kurumlar\u0131 ile \u00f6zel sekt\u00f6r\u00fcn siber dayan\u0131kl\u0131l\u0131\u011f\u0131n\u0131n art\u0131r\u0131lmas\u0131,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Siber olaylara m\u00fcdahale s\u00fcre\u00e7lerinin standart hale getirilmesi,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Denetim ve yapt\u0131r\u0131m mekanizmalar\u0131n\u0131n etkinle\u015ftirilmesi,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Kritik altyap\u0131lar\u0131n korunmas\u0131 ve siber sald\u0131r\u0131lara kar\u015f\u0131 daha cayd\u0131r\u0131c\u0131 \u00f6nlemler al\u0131nmas\u0131 yer almaktad\u0131r.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Bu kapsamda, Siber G\u00fcvenlik Kurulu ve Siber G\u00fcvenlik Ba\u015fkanl\u0131\u011f\u0131 gibi yeni yap\u0131lanmalar \u00f6ng\u00f6r\u00fclmekte, d\u00fczenleyici \u00e7er\u00e7eve geni\u015fletilmektedir.<\/span><\/p>\n<ol start=\"3\">\n<li><b> \u00d6ng\u00f6r\u00fclen \u0130dari Yapt\u0131r\u0131mlar<\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Kanun teklifi, siber g\u00fcvenlik y\u00fck\u00fcml\u00fcl\u00fcklerine uymayan ger\u00e7ek ve t\u00fczel ki\u015filer i\u00e7in idari para cezalar\u0131 ve di\u011fer yapt\u0131r\u0131mlar\u0131 i\u00e7ermektedir. Ba\u015fl\u0131ca d\u00fczenlemeler \u015funlard\u0131r:<\/span><\/p>\n<p><b>3.1. Bilgi Payla\u015f\u0131m\u0131 ve Denetim Y\u00fck\u00fcml\u00fcl\u00fcklerine Uymama<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Yetkili mercilerin talep <\/span><b>etti\u011fi bilgi, belge ve verilerin payla\u015f\u0131lmamas\u0131 veya denetim faaliyetlerinin engellenmesi, 1 y\u0131ldan 3 y\u0131la kadar hapis cezas\u0131 ve idari para cezalar\u0131 ile yapt\u0131r\u0131ma<\/b><span style=\"font-weight: 400;\"> tabi tutulmaktad\u0131r.<\/span><\/p>\n<p><b>3.2. Zorunlu Onay ve \u0130zin Almaks\u0131z\u0131n Faaliyet G\u00f6sterme<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Siber g\u00fcvenlik alan\u0131nda belirlenen yetki veya izinleri almadan faaliyet y\u00fcr\u00fctenler, <\/span><b>2 y\u0131ldan 4 y\u0131la kadar hapis ve idari para cezas\u0131<\/b><span style=\"font-weight: 400;\"> ile kar\u015f\u0131 kar\u015f\u0131ya kalabilir.<\/span><\/p>\n<p><b>3.3. Kritik Altyap\u0131lar\u0131n G\u00fcvenli\u011fini \u0130hmal Etme<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Kritik altyap\u0131lar\u0131n korunmas\u0131na y\u00f6nelik belirlenen y\u00fck\u00fcml\u00fcl\u00fcklere uymayanlar, <\/span><b>1 y\u0131ldan 3 y\u0131la kadar hapis cezas\u0131 ile cezaland\u0131r\u0131labilir<\/b><span style=\"font-weight: 400;\">. Ayr\u0131ca, idari para cezalar\u0131 da uygulanmaktad\u0131r.<\/span><\/p>\n<p><b>3.4. Veri S\u0131z\u0131nt\u0131lar\u0131 ve Yetkisiz Veri Payla\u015f\u0131m\u0131<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ki\u015fisel veya kritik kurumsal verilerin izinsiz payla\u015f\u0131lmas\u0131, <\/span><b>3 y\u0131ldan 5 y\u0131la kadar hapis cezas\u0131na<\/b><span style=\"font-weight: 400;\"> tabidir.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Siber sald\u0131r\u0131lar sonucu ele ge\u00e7irilen verilerin yay\u0131lmas\u0131 veya sat\u0131lmas\u0131 durumunda, ceza <\/span><b>10 y\u0131la kadar art\u0131r\u0131labilir<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ger\u00e7ekle\u015fmemi\u015f bir veri s\u0131z\u0131nt\u0131s\u0131 ile ilgili yanl\u0131\u015f alg\u0131 olu\u015fturarak kamuoyunu yan\u0131ltan ki\u015filer <\/span><b>2 y\u0131ldan 5 y\u0131la kadar hapis cezas\u0131<\/b><span style=\"font-weight: 400;\"> alabilir.<\/span><\/li>\n<\/ul>\n<p><b>3.5. \u0130dari Para Cezalar\u0131<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Kanun teklifi, <\/span><b>mevzuata ayk\u0131r\u0131 hareket edenlere milyonlarca TL\u2019ye varan idari para cezalar\u0131<\/b><span style=\"font-weight: 400;\"> \u00f6ng\u00f6rmektedir:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Siber g\u00fcvenli\u011fe ili\u015fkin \u00f6nlemleri almayanlara <\/span><b>1 milyon TL\u2019den 10 milyon TL\u2019ye kadar<\/b><span style=\"font-weight: 400;\"> idari para cezas\u0131 uygulanabilir.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Denetim y\u00fck\u00fcml\u00fcl\u00fcklerini yerine getirmeyen ticari i\u015fletmeler i\u00e7in <\/span><b>\u015firket cirosunun %1\u2019i ile vergi \u00f6ncesi k\u00e2r\u0131n %20\u2019si aras\u0131nda<\/b><span style=\"font-weight: 400;\"> cezalar \u00f6ng\u00f6r\u00fclmektedir.<\/span><\/li>\n<\/ul>\n<ol start=\"4\">\n<li><b> Uyumluluk ve Al\u0131nmas\u0131 Gereken \u00d6nlemler<\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Mevzuata uyum sa\u011flamak i\u00e7in teknik ve idari tedbirlerin hayata ge\u00e7irilmesi gerekmektedir. \u00d6zellikle:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Siber g\u00fcvenlik denetimlerinin d\u00fczenli olarak yap\u0131lmas\u0131,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Olay m\u00fcdahale planlar\u0131n\u0131n olu\u015fturulmas\u0131,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Siber fark\u0131ndal\u0131k e\u011fitimlerinin art\u0131r\u0131lmas\u0131,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Yetkili mercilere zaman\u0131nda bilgi verilmesi,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Mevzuata uygun teknolojik \u00e7\u00f6z\u00fcmlerin tercih edilmesi \u00f6nem arz etmektedir.<\/span><\/li>\n<\/ul>\n<ol start=\"5\">\n<li><b> Sonu\u00e7<\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Kanun teklifinin yasala\u015fmas\u0131 ile birlikte, <\/span><b>siber g\u00fcvenlik alan\u0131nda daha s\u0131k\u0131 denetimler ve cayd\u0131r\u0131c\u0131 yapt\u0131r\u0131mlar g\u00fcndeme gelecektir<\/b><span style=\"font-weight: 400;\">. G\u00fcncellenen y\u00fck\u00fcml\u00fcl\u00fcklere uyum sa\u011flamak, mevzuata uygun hareket etmek ve olas\u0131 yapt\u0131r\u0131mlardan ka\u00e7\u0131nmak i\u00e7in gerekli ad\u0131mlar\u0131n zaman\u0131nda at\u0131lmas\u0131 kritik \u00f6nem ta\u015f\u0131maktad\u0131r.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Siber G\u00fcvenlik Kanunu\u2019nun kabul\u00fcyle beraber kamu kurumlar\u0131 kadar \u00f6zel sekt\u00f6r \u015firketleri de do\u011frudan y\u00fck\u00fcml\u00fc hale gelmi\u015ftir. Mevcut d\u00fczenlemelerin aksine, bu yasa yaln\u0131zca devlet kurumlar\u0131n\u0131 de\u011fil, \u00f6zel \u015firketleri, hizmet sa\u011flay\u0131c\u0131lar\u0131 ve kurumsal IT birimlerini de kapsam\u0131\u015ft\u0131r.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Dolay\u0131s\u0131yla T\u00fcrkiye\u2019de faaliyet g\u00f6steren \u015firketlerin, daha s\u0131k\u0131 siber g\u00fcvenlik gerekliliklerine ve olas\u0131 idari yapt\u0131r\u0131mlara kar\u015f\u0131 haz\u0131rl\u0131kl\u0131 olmas\u0131 gerekmektedir.
