Mevzuat uyar\u0131nca, bir ticari uygulaman\u0131n haks\u0131z say\u0131lmas\u0131 i\u00e7in mesleki \u00f6zenin gereklerine uymamas\u0131 ve ortalama t\u00fcketicinin bir mal veya hizmete ili\u015fkin ekonomik davran\u0131\u015f bi\u00e7imini \u00f6nemli \u00f6l\u00e7\u00fcde bozmas\u0131 yeterli g\u00f6r\u00fclmektedir.<\/p>\n<p>Buradaki kritik e\u015fik, t\u00fcketicinin bilin\u00e7li karar verme yetene\u011finin azalt\u0131lmas\u0131d\u0131r. Hukuki \u00e7er\u00e7evede bir reklam\u0131n hukuka ayk\u0131r\u0131 say\u0131labilmesi i\u00e7in mutlaka do\u011frudan bir yalan i\u00e7ermesi gerekmemekte; d\u00fcr\u00fcstl\u00fck kural\u0131na ayk\u0131r\u0131l\u0131k ve t\u00fcketicinin ekonomik davran\u0131\u015f\u0131n\u0131n bozulmas\u0131 yeterli g\u00f6r\u00fclmektedir.<\/p>\n<p>Kurul uygulamas\u0131nda esas al\u0131nan temel \u00f6l\u00e7\u00fct, reklam\u0131n <strong>ortalama t\u00fcketici<\/strong> \u00fczerindeki etkisidir. B\u00f6ylece karanl\u0131k ticari tasar\u0131mlar, do\u011frudan yan\u0131lt\u0131c\u0131 reklam veya haks\u0131z ticari uygulama kapsam\u0131nda ele al\u0131nabilmektedir.<\/p>\n<p>Son y\u0131llarda Reklam Kurulu taraf\u0131ndan yap\u0131lan de\u011ferlendirmelerde, yaln\u0131zca reklam metinleri de\u011fil; reklam\u0131n sunuldu\u011fu aray\u00fcz tasar\u0131m\u0131, buton yerle\u015fimleri ve kullan\u0131c\u0131 y\u00f6nlendirmeleri de hukuka ayk\u0131r\u0131l\u0131k tespitinde belirleyici olmu\u015ftur.<\/p>\n<p>\u00d6zellikle abonelik hizmetlerinde kar\u015f\u0131m\u0131za \u00e7\u0131kan &#8220;iptal butonunun gizlenmesi&#8221; veya &#8220;onay butonunun daha parlak renklerle \u00f6ne \u00e7\u0131kar\u0131lmas\u0131&#8221; gibi y\u00f6ntemler, Kurul taraf\u0131ndan haks\u0131z ticari uygulama olarak nitelendirilmektedir.<\/p>\n<p>\u00d6rne\u011fin, Reklam Kurulu\u2019nun 2024\/5159 say\u0131l\u0131 &#8220;Spotify&#8221; karar\u0131nda, &#8220;1 ay \u00fccretsiz dene&#8221; teklifinin sunulmas\u0131na ra\u011fmen t\u00fcketicilerin kredi kart\u0131 bilgilerini girmeye zorlanmas\u0131 ve iptal s\u00fcre\u00e7lerinin \u00fcyelik ba\u015flatmaya k\u0131yasla \u00e7ok daha karma\u015f\u0131k kurgulanmas\u0131 hukuka ayk\u0131r\u0131 bulunmu\u015ftur.
